1. Operator and Acceptance
Pixelmap Builder is operated and licensed by Julio Valdes Fernandez under the Pixelmap Builder brand ("Pixelmap Builder," "we," "us," or "our"). By accessing this website or downloading, purchasing, or using the Pixelmap Builder application (the "App"), you agree to these Terms & Conditions. If you do not agree, do not use the App or website.
If you are not legally able to enter into a binding agreement where you live, a parent or legal guardian must review and agree to these terms on your behalf where permitted by law.
2. Apple Standard EULA and Order of Terms
The App is distributed through the Apple App Store under Apple's Standard Licensed Application End User License Agreement (Standard EULA). The Standard EULA is the primary license governing your use of the App. These Terms supplement the Standard EULA and govern the website, product-specific rules, purchases, features, outputs, and services described here.
Apple's Media Services Terms and any terms shown during an App Store purchase also apply. If these Terms conflict with the Standard EULA regarding the App license, the Standard EULA controls. Nothing here makes Apple responsible for obligations assigned to the developer under the Standard EULA.
3. Purpose of Pixelmap Builder
Pixelmap Builder is a professional productivity tool that assists with the creation, arrangement, visualization, testing, and export of LED screen pixel maps, wiring plans, project files, and related production layouts.
4. Technical Verification Is Your Responsibility
You are responsible for reviewing and independently verifying all project dimensions, pixel counts, coordinates, mappings, exports, wiring information, power and data requirements, equipment compatibility, and other output before using it in a live production or hardware configuration. Pixelmap Builder is an aid and does not replace manufacturer documentation, site inspection, safety procedures, qualified engineering, or professional judgment.
You are responsible for backing up important projects and exports. Do not rely on the App as the only copy of production-critical information.
5. License and Permitted Use
Subject to the Apple Standard EULA, these Terms, and applicable law, you receive a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on supported devices for lawful purposes. You may use original outputs you create with Pixelmap Builder in your personal or commercial production work.
Your right to use third-party logos, images, project data, or other materials included in an output depends on the rights you hold in those materials. You are responsible for obtaining any necessary permissions.
6. Restrictions
You may not misuse the App or website; interfere with security or operation; attempt unauthorized access; distribute unauthorized copies; bypass purchase, entitlement, or technical controls; reverse engineer or modify the App except where applicable law expressly permits it; use the product to violate another person's rights; or use Pixelmap Builder in violation of law.
7. Free Use, Premium, and the One-Day Pass
The App may include a limited number of free exports. Current paid options may include monthly and annual Pixelmap Premium auto-renewing subscriptions and a time-limited one-day Premium pass. The features, duration, price, taxes, trial terms, and availability displayed in the App Store purchase screen at the time of purchase are the terms of that transaction.
Premium provides access to the paid features described at purchase while the applicable entitlement remains active. A one-day pass provides access for the period displayed at purchase and is not an auto-renewing subscription unless the Apple purchase screen expressly identifies it as one.
8. Billing, Renewal, Cancellation, and Refunds
Apple processes all App Store payments. Auto-renewing subscriptions renew and are charged through your Apple account unless cancelled in accordance with Apple's purchase terms and the settings shown for your subscription. You can manage or cancel a subscription in your Apple account settings; deleting the App does not cancel a subscription.
Refund requests, payment disputes, taxes, regional pricing, and billing issues are handled by Apple under its policies. We do not receive your full payment-card information and cannot directly issue an App Store refund. Features and pricing may change prospectively as permitted by law and platform rules; a change does not remove mandatory consumer rights.
9. Availability, Compatibility, and Updates
Features may be added, changed, improved, or discontinued, and device, operating-system, or service compatibility may change over time. We may release updates to maintain compatibility, improve performance, address security or reliability, or introduce functionality. We do not guarantee that every feature, third-party integration, file format, or service will remain available indefinitely.
10. Ownership
Pixelmap Builder, including its software, website, name, branding, interface, design, documentation, and original content, is owned by or licensed to Julio Valdes Fernandez and is protected by applicable intellectual-property laws. Except for the limited rights expressly granted here and under the Standard EULA, no rights are transferred to you.
11. Third-Party Services and Formats
Pixelmap Builder may interact with or link to third-party platforms, devices, formats, or services, including Apple, Instagram, media-server tools, and LED hardware ecosystems. Those third parties are governed by their own terms and policies and may change their services independently. Compatibility references do not imply sponsorship, affiliation, or endorsement unless expressly stated.
12. Privacy
Our handling of information is described in the Pixelmap Builder Privacy Policy, which is incorporated into these Terms by reference.
13. Disclaimer of Warranties
To the maximum extent permitted by law, Pixelmap Builder is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, perfect accuracy, compatibility with every device or LED system, preservation of every project, or fitness for a particular production. Any warranties that cannot legally be excluded remain in effect to the extent required by law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Julio Valdes Fernandez and Pixelmap Builder will not be liable for indirect, incidental, special, consequential, exemplary, or production-related losses arising from use of, or inability to use, the App or website, including lost data, revenue, opportunity, show time, equipment availability, or losses caused by relying on unverified output.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer protections that apply to you.
15. Suspension or Termination
We may restrict access to website features or connected services when reasonably necessary to protect Pixelmap Builder, users, or third parties; address misuse or security risks; or comply with law. Your App license may also end as provided by the Apple Standard EULA. Provisions concerning ownership, payment obligations, disclaimers, liability, and dispute-related rights survive where their nature requires it.
16. Changes to These Terms
We may update these Terms as the product, purchases, or legal requirements evolve. We will update the effective date above and provide any additional notice required by applicable law. Changes apply prospectively. Continued use after updated terms take effect constitutes acceptance where permitted by law.
17. Applicable Law and Consumer Rights
These Terms are interpreted under the law that applies to the relationship between you and the operator. Nothing in these Terms selects a law or forum that removes mandatory rights available to you as a consumer in your place of residence. Any dispute must be brought before a court or process that has jurisdiction under applicable law, after the parties make a reasonable effort to resolve it directly where appropriate.
18. Severability and No Waiver
If any provision is found unlawful or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision once is not a waiver of the right to enforce it later.
